Power hour terms of service

Services
All services are provided by Helen Feeley T/A Indie Marketing.
The services provided under these terms relate to our 90 day business strategy planning session 1:1 power hours where you will get:

A one to one business strategy session delivered via video call, lasting 60 minutes;

The call will support you to put in place a clear goal for the next 90 days and support you with the steps required for you to implement and reach that goal;

Following the call a short email will be provided setting out the action plan and next steps. Where relevant, we may also make recommendations as to how we can support you to achieve your goals.

It is important that you are aware that all services are delivered virtually. Whilst we can put in place an agreed action plan, the success to be achieved after the session is dependent on you sharing honestly and transparently your intentions and commitment to achieving the goal and then taking action on the agreed next steps.
Whilst many clients experience instant wins either during or shortly after the session, we offer no guarantees or timelines. Each person is different and results may vary.
Where possible services are performed by Helen Feeley. We reserve the right to outsource to a Co-Coach if required, where this happens as much notice as possible will be provided.
2. Fees and Payment Terms Including Refund and Rescheduling
The fees for all one off sessions in advance and shall be paid online via the checkout on our website. VAT is not charged and there are no additional expenses.
Should you need to change your booking you will be able to do so providing that you give 48 hours’ notice. Notice should be provided by email. If there is less than 48 hours before your session you will not be able to reschedule and you will still be charged.
If you make a booking and wish to cancel within the first 14 days, you will receive a refund, as long as your session is not due to take place within 48 hours of the time when the booking is made. If you make a booking with less than 48 hours’ before the session is due to take place you will not be permitted to reschedule or be permitted a refund if you are unable to attend, so you should carefully consider your diary before booking. You will not be entitled to a refund where you change your mind and request a refund more than 14 days have passed following the time of booking. All refunds will be provided in accordance with your statutory rights.

3. Intellectual Property Rights
We retain all copyright in any document prepared in the course of carrying out any services on your behalf. Should you wish to use the document for additional purposes a licence fee can be agreed.

4. Communications
Communication with clients will be via email or telephone unless otherwise agreed in advance. Electronic communications are not totally secure and we cannot be held responsible for damage or loss caused by viruses. Our usual business hours are 9am until 5pm UK time, Monday to Thursday, excluding bank holidays. Outside of these times responses to any communications may not be read or responded to. Please be aware that as part of the content strategy for our business, social media posts may be uploaded to social channels outside of these hours.

5. Data Protection

6. Confidentiality and Retention of Information
Communications between us are confidential. We will take all reasonable steps not to disclose personal information about you and your business save for in circumstances as required by law or by me to perform the internal operations of my business, such as disclosure to an accountant.
Documents and information in relation to your matters will not be held longer than required by insurance provider obligations.

7. Complaints
We are committed to providing you with a high-quality service that is both efficient and effective. However, should there be any cause for complaint in relation to any aspect of our service, please contact hello@indiemarketing.co. We agree to look into your complaint carefully and promptly and take reasonable steps to resolve it.

8. Limitation of Liability
Services are provided to you with reasonable care and skill. Any liability to you is limited to the amount of any fees paid.
We do not and cannot guarantee any specific results in respect of the services delivered unless they are detailed above. There will not be any liability to you for any delay or failure to perform our obligations if the delay or failure is caused by circumstances outside our reasonable control.

9. Third Party Rights
No person other than the person provided with a copy of these terms shall be deemed to have the benefit of the services, or have any rights to enforce or rely on any of the terms.

10. Applicable Law
These Terms of Business are our standard terms and conditions of business and should at all times be construed in accordance with the English Law.
The courts of England & Wales will have exclusive jurisdiction in relation to any claim, or dispute arising out of this engagement or any matter arising from it.
